US Court of Federal Claims issues an Amended General Order – Filing, Service and Management (including redaction) of Highly Sensitive Documents

On March 9, 2021, the U.S. Court of Federal Claims, Hon. Elaine D. Kaplan, Chief Judge, issued an Amended General Order outlining the Procedures for Filing, Service, and Management of Highly Sensitive Documents (HSDs). 

The Amended Order, which is effective immediately, applies to any document that contains information that involves matters of national security, foreign sovereign interests, or cybersecurity; a document that contains government enforcement information; a document describing closely held trade secrets; or a document that implicates the reputational interests of the United States.  The Amended Order defines what is, and what is generally not, considered an HSD; how to request that a document be treated as an HSD; and how to resolve disputes regarding a document’s status as an HSD.
